Did you know that one in three tax assessments is incorrect?

Since accurate and critical examination of tax assessments is often neglected, the tax authorities regularly collect money to which they are not legally entitled!

However, many citizens still refrain from enforcing their rights with the appropriate procedural means. Overwhelmed by the volume and complexity of tax regulations, administrative acts are often accepted far too quickly without objection. We know from our daily practice that a targeted, professionally worded letter is often enough to force the tax office to back down and correct unlawful tax assessments. In many cases, however, further steps are necessary and conflicts with the tax authorities must be settled before the tax courts. According to statistics, a high proportion of tax proceedings end with decisions favourable to the taxpayer. Is this a reason to rejoice? Hardly, as it clearly shows that the tax authorities often initially follow purely fiscal arguments when assessing taxes and show little interest in considering a case from the taxpayer’s perspective. The fact that many people still shy away from legal disputes often plays into the hands of the tax office.

When might a tax audit take place?

You will be informed before a tax audit takes place, but the auditor will usually already have some information about you and your company (balance sheets, tax returns, audit notices, etc.). They will use this information to prepare for the external audit. It is therefore a good idea to consider the following factors in advance:

  • You have made large contributions to your business assets while your private assets are low.
  • Your company has generated losses over several years.
  • Your business assets or personal assets are growing without corresponding income.
  • Your income is too low compared to the normal cost of living.
  • Your lifestyle does not match your income.
  • Your profit is below the industry average, as indicated by the profit guidelines.
  • Your turnover fluctuates greatly for no apparent reason.
  • Deposit or withdrawal of real estate into or from business assets.
  • You change the legal form of the company or give it up.
  • You do not meet your tax obligations or do not meet them on time.
  • Previous audits have resulted in high additional payments.
